Many clients live, work or study in both countries. We look at how an immigration choice affects your tax, employment, family and property, and work with our other teams so the advice fits together.

Spanish visa refusal overturned in the High Court of Justice of Madrid

Our client's Non-Lucrative Residence Visa was refused because of criminal-record issues, even though an official UK certificate showed no active entries. Our Immigration and Litigation teams challenged the decision. The Court overturned the refusal, confirmed our client's right to the visa, and ordered the Spanish State Administration to pay the legal costs.

Common questions

Do you also handle UK visas and British citizenship?

Yes: Skilled Worker and other sponsored routes, family and partner visas, student and graduate visas, settlement (ILR) and British citizenship — and sponsor licences for employers.

Can a criminal record stop me getting a Spanish visa?

Not automatically. Every application must be assessed on its facts: the nature of the offence, when it occurred, the applicable law and the immigration route. We have helped clients with criminal records obtain Spanish visas and residence permits, and we challenge refusals that are wrong in law.

Does the Digital Nomad Visa include my family?

Yes. A successful applicant can bring their spouse and their children under 18 — and over 18 if they are still financially dependent.

How long can a Digital Nomad Visa holder stay in Spain?

The Digital Nomad Visa is granted for 1 year. After that, holders can apply for a 3-year residence permit, followed by 2-year renewals.

I missed the Ley de Memoria Democrática deadline. Can I still move to Spain?

Possibly. If your parent obtained Spanish nationality under that Law as a Spanish citizen of origin, you may be able to apply for a 5-year residence permit under Article 94.1.h of the Reglamento de Extranjería. Each case must be assessed individually.

How much does a Non-Lucrative Visa application cost?

Our fee is £1,500 plus VAT per adult applicant and £250 plus VAT per minor, payable in advance. Consular fees (£516 per applicant), sworn translations and legalisation are extra.

This is general information, not legal advice. Every case must be assessed individually.
